Notice of Privacy Practices
Effective Date: [ September 15, 20125] This Notice of Privacy Practices (“Notice”) describes how Global Overview SL d/b/a H24 Psychology (“we,” “us,” “our”) may use and disclose your Protected Health Information (PHI) and how you can access this information. We are required by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and related regulations to maintain the privacy and security of your PHI and to provide you with this Notice.1) Our Duties
- We are required by law to keep your PHI private and secure.
- We will notify you in the event of a breach of unsecured PHI.
- We must follow the terms of this Notice until it is replaced.
2) Your Rights
You have the right to:- Access your PHI: Request a copy of your health records, usually within 30 days. We may charge a reasonable fee.
- Correct your PHI: Request corrections if you believe your information is incomplete or inaccurate.
- Request restrictions: Ask us not to use or disclose certain information for treatment, payment, or healthcare operations (we may not always agree, but will comply when legally required).
- Confidential communications: Request that we contact you in a specific way (e.g., only at work or by mail).
- Accounting of disclosures: Receive a list of certain disclosures of your PHI made in the last six years.
- Paper copy: Request a paper copy of this Notice at any time.
- Choose a representative: If you have given someone legal authority (guardian, power of attorney), that person may exercise your rights.
- File a complaint: If you believe your rights are violated, you may file a complaint with us or with the U.S. Department of Health & Human Services (HHS). We will not retaliate.
3) How We May Use and Disclose PHI
We may use or share your PHI without your written authorization in the following ways:- Treatment: Share with doctors, psychologists, or other providers involved in your care.
- Payment: Use or disclose PHI to bill and receive payment for services.
- Healthcare operations: Use for administrative purposes, quality improvement, training, and accreditation.
- Business associates: Share with vendors providing services (e.g., hosting, billing, telehealth platform) under a HIPAA-compliant agreement.
- Public health and safety: Report to health authorities for disease control, child abuse, or threats to safety.
- Legal requirements: Respond to court orders, subpoenas, law enforcement requests, or regulatory investigations.
- Research: Use PHI for approved research under HIPAA safeguards.
- Organ/tissue donation: Share with organ procurement organizations.
- Workers’ compensation: Comply with workers’ compensation laws.
- Government functions: For specialized government services (military, national security).
- Disaster relief: Share PHI to assist in disaster response and notifications.
4) Uses and Disclosures Requiring Authorization
We will not use or disclose your PHI without your written authorization for:- Marketing communications using PHI (except limited face-to-face communications or small gifts).
- Sale of PHI.
- Psychotherapy notes, except for limited treatment, payment, or legal defense purposes.
5) Special Protections
Certain types of PHI may have additional protections under state or federal law, including:- Mental health/psychotherapy notes
- Substance use disorder treatment records (42 CFR Part 2)
- HIV/AIDS-related information
- Genetic information
6) Our Responsibilities Regarding Telehealth
- We use secure platforms (e.g., Zoom for Healthcare, Doxy.me, Bunny.net) under HIPAA-compliant agreements.
- Sessions may not be recorded without your consent.
- We apply appropriate safeguards to protect electronic PHI (encryption, access controls).
7) Changes to This Notice
